Terms of Service
webskts is operated by Bhespoke L.L.C.
Effective 29 October 2026.
PLEASE READ THESE TERMS CAREFULLY
They govern access to and use of webskts.com and create a binding agreement between you and Bhespoke L.L.C. By creating an account, subscribing to a paid plan, creating a Project, sending or receiving Messages through the Service, or otherwise using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
1. Definitions and Scope
"Bhespoke," "we," "us," and "our" mean Bhespoke L.L.C., a California limited liability company. "Service" means webskts.com, the real-time messaging service it provides (including its connection hosts, API, and browser client), and their related applications, features, documentation, communications, and services. "Customer" means a person or organization that creates an account. "Project" means a set of Credentials, Channels, settings, and a connection domain within an account, through which a Customer sends Messages. "Credentials" means a Project's API key and connection ID. "Channel" means a named stream within a Project to which End Users subscribe. "Message" means data a Customer sends through the Service for delivery to End Users. "End User" means a person, browser, device, or application that connects to the Service through a Customer's application. "Content" means Messages, Channel names, Project names and settings, and other materials submitted to or made available through the Service.
These Terms apply to every visitor and registered user, and to every Customer's use of the Service on behalf of its End Users. Additional terms presented in connection with a particular feature, promotion, payment method, plan offer, or third-party service also apply. If those additional terms conflict with these Terms, the additional terms control only for that feature or transaction.
2. Eligibility, Accounts, and Security
You must be at least eighteen (18) years old and legally capable of entering a binding contract to create an account, create a Project, or begin a paid plan. If you use the Service on behalf of a company or other organization, you represent that you are authorized to accept these Terms for it, and "you" includes that organization. By using the Service, you represent that you satisfy these requirements. The Service is not directed to children under thirteen (13).
You must provide accurate, current information and keep it updated. You are responsible for safeguarding your credentials, including your password and your Projects' API keys, and for activity under your account. Notify us promptly through the Contact us page if you suspect unauthorized access. You may not impersonate another person, create deceptive accounts, share credentials in a manner that compromises security, use automated means to create accounts, or use several accounts to evade usage limits.
3. The Service and Relationship of the Parties
Bhespoke L.L.C. provides technology that enables Customers to send Messages from their servers to their End Users' browsers, apps, and devices over persistent connections, and to manage their Projects, Credentials, plans, and usage. Customers are independent users and are not employees, agents, joint venturers, or partners of Bhespoke L.L.C. End Users are the Customer's users, not ours. We are not a party to any relationship between a Customer and its End Users, and we are not responsible for a Customer's application or for what its Messages say, except to the extent expressly stated in these Terms.
We may add, modify, suspend, or discontinue features. We do not promise that any feature, plan, price, limit, or geographic availability will remain available.
The Service is currently in beta. During the beta, creating an account may require an invitation code, and people without one may join a waiting list. While a notice on the plans and billing pages says that payments are in test mode, no card is charged, and a paid plan chosen then lasts only until payments go live. We will tell account holders by email before the beta ends and before anything they have for free becomes chargeable. Nothing you create during the beta is lost when it ends.
4. Terms for Customers
4.1 Projects and Credentials
A Customer may create Projects within the limits of their plan. Each Project has an API key, which is secret and is used only by the Customer's servers to send Messages, and a connection ID, which appears in every page or app that connects and is therefore not secret. Anyone who has a Project's connection ID can subscribe to its Channels, receive the Messages sent on them, and use the Project's connections, unless the Customer limits that with the Project's allowed websites and allowed API addresses. The Service does not currently offer Channels that require a signature from the Customer's server to join, so a Customer must not send on a Channel anything it would not show to everyone who has the connection ID. Customers are responsible for keeping their API keys secret, for choosing what to send on each Channel, and for rotating Credentials that may have leaked.
4.2 Ownership and License
As between you and Bhespoke L.L.C., you retain ownership of your Content. You grant Bhespoke L.L.C. a worldwide, non-exclusive, royalty-free, sublicensable license during the period your Content is hosted or reasonably retained to host, reproduce, store, display, transmit, secure, moderate, and otherwise use the Content solely to operate, improve, and protect the Service. We will not use your Content in public marketing without your permission. The license ends when the Content is deleted, subject to the retention, backup, legal-compliance, and dispute-preservation periods described in these Terms and the Privacy Policy.
4.3 End Users' Information
You represent and warrant that you own or have obtained every right and consent necessary for your Content and our permitted uses, including any personal information about End Users that your Messages, Channel names, or Project settings contain. You are solely responsible for your applications, for the notices you give End Users and the consents you obtain from them, and for complying with every privacy, consumer-protection, and electronic-communications law that applies to them. When we process personal information in your Content, we do so on your behalf and on your instructions, only to provide the Service, as described in Section 8 and the Privacy Policy. You may not send through the Service payment card numbers, government identification numbers, health information, or other information that a law or industry standard requires to be handled with special safeguards, unless you encrypt it so that we cannot read it.
4.4 Plans, Fees, and Automatic Renewal
The Free plan is free. Paid plans are charged in advance, monthly or yearly as you choose (some plans are offered yearly only), through our payment provider Stripe. The limits of each plan, including how many Messages may be sent each hour, day, and month, how many connections and Channels may be open, and how many Projects an account may have, are described on the plans page. Prices are in US dollars and do not include tax; any tax that applies is added to the charge. The Enterprise plan is arranged by an offer we make to you, under the Enterprise terms you accept with it, which add to these Terms and control where they differ.
A paid plan renews automatically on the disclosed monthly or yearly cycle until you cancel it. Before you subscribe, the checkout flow will disclose the plan, price, billing frequency, renewal terms, and how to cancel. By selecting the purchase control, you expressly authorize recurring charges to your selected payment method through Stripe until cancellation.
We may revise prices prospectively on at least thirty (30) days' notice by email. Fees already charged are nonrefundable except as required by law or expressly stated otherwise.
4.5 Changing Plans, Cancellation, and Refunds
Moving to a different paid plan takes effect as soon as it is paid. If the new plan costs more for the rest of the current period, you pay the difference at once; if it costs less, nothing is charged and the difference comes off your next bills. Moving between monthly and yearly billing starts the new period on the day of the change, and what is left of the current period comes off its price. If the payment for a change is declined or your bank asks you to confirm it, you stay on your current plan until it is paid, and the change lapses if it is not paid within about a day.
You may cancel a paid plan from your billing page at any time. Cancelling stops the next renewal, your paid plan continues through the paid billing period, the account then moves to the Free plan, and nothing more is charged. You can resume the plan before the cancellation takes effect. Charges are not prorated or refunded except as described in this Section or required by law. Deleting your account stops a paid plan at once, and we refund the unused part of the current period, together with the tax charged on it.
If you move to a plan that includes fewer Projects than you have, the extra Projects are paused, not deleted: their connections are closed, their settings are kept, and you choose which Projects stay active. Moving to a bigger plan resumes them. A connection domain the new plan does not include is released.
4.6 Message Storage and Delivery
The Service delivers Messages; it is not a place to store them. Each Message is kept for up to sixty (60) seconds so that a client that reconnects can catch up on what it missed, and is then deleted. It is deleted sooner once one thousand (1,000) newer Messages exist on the same Channel, and a server restart can lose it sooner. An End User that is not connected when a Message is sent, and does not reconnect within that time, does not receive it. Messages are not acknowledged or resent, and their delivery, order, and size limits are as described in the documentation.
Customers must keep their own copy of anything they need, and must design their applications so that a Message that is delayed, lost, or delivered more than once does no harm. Bhespoke L.L.C. is not responsible for loss of Content that a Customer failed to preserve independently.
4.7 Project and Account Deletion
A Customer may delete a Project, other than their last one, or close their account, through available account controls. Deleting a Project stops its Credentials and closes its connections at once. Closing an account does the same for every Project and stops any paid plan, as described in Section 4.5. Deleted Content cannot be recovered. Remaining account data is handled under the Privacy Policy and applicable record-retention duties.
4.8 Content Rules
You may not create a Project, publish, transmit, or name a Channel with Content that:
- infringes copyright, trademark, privacy, publicity, contractual, or other rights;
- contains unlawful threats, targeted harassment, doxxing, or incitement to violence;
- promotes hatred or violence against a protected class;
- sexually exploits, targets, or depicts minors, or includes unlawful sexually explicit material;
- contains malware, phishing, fraudulent material, deceptive links, or content intended to manipulate the Service; or
- is used to command or control malware, botnets, or other software running without its owners' authorization.
We may investigate reports, remove or restrict Content, suspend or terminate accounts or Projects, preserve evidence, and cooperate with lawful process. When practical, we will notify the affected Customer and provide an opportunity to respond, but immediate action may be taken for urgent, repeated, or egregious violations.
4.9 Usage Limits
The Service enforces each plan's limits. When a limit is reached, further Messages or connections are refused until the limit resets; hourly, daily, and monthly limits reset at the start of each hour, day, and month in Coordinated Universal Time (UTC). Nothing is charged for use above a limit. We email the account holder when daily or monthly use nears and reaches a limit. If a limit is too low for your use, you may move to a bigger plan or contact us.
4.10 Connection Domains
Some plans let a Customer's End Users connect through a subdomain of webskts.com or through a domain the Customer controls. You may claim only a domain you control, and you must keep the DNS records we ask for in place while you use it. We may refuse or release a subdomain that is reserved, misleading, or infringes another person's rights. A subdomain or domain is released when the plan no longer includes it or the Project is deleted.
5. Your Applications and End Users
5.1 Connecting to the Service
End Users connect to the Service through a Customer's application and do not need an account with us. A Customer is responsible for its End Users' use of the Service through its Projects as if it were its own, and must make sure that use complies with Sections 4.8 and 9.
5.2 Credentials and the Browser Client
Keep your API key on your servers; never put it in a web page, a mobile app, or any other code that End Users receive. Anyone holding it can send Messages as your Project and use its limits. You may load our browser client from our site or host a copy yourself; each published version of it never changes. We may update the Service's protocol, and will give reasonable notice before a change that requires Customers to change their applications.
5.3 Access and Restrictions
Access to a Project is for its Customer and the End Users of its applications, and is limited and revocable. You may not use another Customer's Credentials or Channels without their permission, impersonate another Customer, open accounts or Projects to get around a plan's limits, circumvent technical controls, scrape, or use the Service or Service data except as expressly permitted.
5.4 End Users' Requests
If an End User asks us about personal information in your Content, we will refer them to you, and you are responsible for responding. We will give you reasonable help where only we can act, for example to delete information held on our servers.
6. Payments, Taxes, and Chargebacks
Stripe processes charges, refunds, and receipts for paid plans. You authorize Stripe and Bhespoke L.L.C. to take the payment actions necessary to provide the Service. Prices do not include tax; Stripe works out any tax that applies from your billing address and any tax ID you give, and it is added to the charge. You are responsible for any other taxes imposed on your purchases or activities, except taxes imposed on Bhespoke L.L.C.'s net income. If a payment fails, we email you and Stripe tries again; if it still cannot be collected, the account's Projects are suspended until it is paid. A disputed payment suspends the account's Projects until the dispute is resolved. Fraudulent disputes and chargeback abuse may result in suspension, collection activity, or termination.
7. Copyright Complaints and Counter-Notices
Bhespoke L.L.C. respects intellectual-property rights and may remove or disable access to allegedly infringing material. A copyright notice should identify the copyrighted work, identify and locate the material, provide the complaining party's contact information, contain a good-faith statement that the disputed use is unauthorized, contain a statement under penalty of perjury that the notice is accurate and the sender is authorized to act, and include a physical or electronic signature. Submit notices through the Contact us page on webskts.com. A user may submit a legally sufficient counter-notice through the same channel. We may terminate repeat infringers in appropriate circumstances.
8. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information and is incorporated into these Terms. Where we process personal information in a Customer's Content on its behalf, we act as its service provider: we use that information only to provide the Service, keep it confidential, and do not sell or share it. If your organization needs a data processing agreement, contact us.
9. Acceptable Use and Enforcement
You may not interfere with the Service; probe or bypass security; introduce malicious code; access another user's account, Project, or Channels; scrape or harvest data; harass anyone; send unsolicited messages at scale; collect information about people under false pretenses; load-test the Service beyond your plan's limits without our permission; resell the Service itself, as a stand-alone messaging service, without our written permission; reverse engineer except where a non-waivable law permits it; use the Service for unlawful, deceptive, sanctioned, or export-restricted activity; or assist another person in doing so. We may use automated and manual measures to prevent abuse and enforce these Terms.
10. Third-Party Services and Links
The Service relies on or may link to third-party services, including Stripe, Cloudflare, Hetzner, email providers, the certificate authorities that issue certificates for connection domains, and the DNS providers whose records Customers manage. Those services are governed by their own terms and policies. We are not responsible for third-party services, content, availability, security, or practices, except to the extent liability cannot lawfully be excluded.
11. Service Availability and Changes
On the Free and Basic plans, the Service is provided on a commercially reasonable, best-efforts basis without a service-level agreement. Maintenance, failures, third-party outages, security events, legal requirements, or other circumstances may interrupt access. We may take remedial steps, but an interruption does not create an automatic right to a refund except as expressly stated in these Terms or required by law. If we discontinue the Service as a whole, we will give account holders reasonable notice.
On the Pro, Max, and Enterprise plans, we aim for the Service to be available ninety-nine point nine percent (99.9%) of the time in each calendar month ("Monthly Uptime"). For this purpose, the Service is available when End Users can open connections to a Project and the Customer's servers can send Messages through the API; the website, dashboard, and billing pages are not included. Monthly Uptime is measured by our monitoring and excludes (a) maintenance we announce at least forty-eight (48) hours in advance, (b) problems caused by you, your applications, your End Users, or networks and services outside our control, (c) refusals because a plan limit was reached or a Project was suspended or paused under these Terms, and (d) events beyond our reasonable control.
If Monthly Uptime falls below 99.9%, you may ask for a service credit through the Contact us page within thirty (30) days after the month ends. The credit is ten percent (10%) of that month's plan fee below 99.9%, twenty-five percent (25%) below 99.0%, and fifty percent (50%) below 95.0%; for a yearly plan, the month's fee is one twelfth of the yearly fee. Credits are applied to future invoices, are not paid in cash, and are not available while an account is past due. An Enterprise offer may set different terms. Service credits are your sole and exclusive remedy for unavailability of the Service.
12. Suspension and Termination
You may stop using the Service at any time. We may suspend, restrict, or terminate access for breach, fraud, payment failure, a disputed payment, risk to users or the Service, legal process, prolonged inactivity, or discontinuation of the Service. Suspending a Project closes its connections at once. When reasonably practicable, we will provide notice and an opportunity to cure. Sections that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, limitations, indemnity, dispute terms, and general provisions.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." BHESPOKE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. EXCEPT AS STATED IN SECTION 11, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR RESULT, THAT ANY MESSAGE WILL BE DELIVERED, OR THAT CONTENT IS ACCURATE, LAWFUL, OR AVAILABLE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHESPOKE AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITY; LOSS ARISING FROM A MESSAGE THAT WAS DELAYED, NOT DELIVERED, OR DELIVERED MORE THAN ONCE, OR FROM ANYTHING A CUSTOMER OR END USER DID OR DID NOT DO; OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BHESPOKE IN PLAN FEES DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED DOLLARS ($100). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY FOR INTENTIONAL MISCONDUCT, FRAUD, OR PERSONAL INJURY CAUSED BY GROSS NEGLIGENCE TO THE EXTENT APPLICABLE LAW SO PROVIDES.
15. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Bhespoke and its members, officers, employees, contractors, and agents from claims, damages, losses, liabilities, judgments, settlements, penalties, and reasonable attorneys' fees arising from your Content, your applications, your End Users' use of the Service through your Projects, your breach of these Terms, your violation of law or third-party rights, or your misuse of the Service. Bhespoke may control the defense of a covered claim, and you will reasonably cooperate. This section does not require a consumer to indemnify Bhespoke for Bhespoke's own unlawful conduct.
16. Disputes, Governing Law, and Venue
These Terms are governed by California law, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs any arbitration agreement separately accepted by the parties. Any action not subject to a separately accepted arbitration agreement must be brought exclusively in a state or federal court of competent jurisdiction in California. You and Bhespoke consent to personal jurisdiction and venue there. Nothing in this section limits rights or remedies that cannot be waived under applicable consumer law.
17. Changes to These Terms
We may revise these Terms. We will post the updated version and effective date. For a material change, we will provide at least thirty (30) days' advance notice by email, in-product notice, or another reasonable method. If a change materially affects an existing paid plan, it will apply no earlier than the next renewal unless required sooner by law or security needs. Continued use after the effective date constitutes acceptance; if you do not agree, stop using the Service and cancel your paid plan before the change takes effect.
18. General Terms
These Terms and incorporated policies are the entire agreement concerning the Service. You may not assign them without our written consent; we may assign them in connection with a merger, reorganization, sale of assets, or by operation of law. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain effective. Headings are for convenience. No third party is a beneficiary. Electronic communications and assent have the same effect as written communications and signatures.
19. Contact
Questions, legal notices, and support requests may be submitted through the Contact us page on webskts.com, or by email to [email protected].
